Dah settle payment? Bini aku dulu pernah gak dapat perintah bayar ni... tapi the company mmg specially designed to con ppl... they just shut down the company when it's time to pay. We've asked the "judge" from the tribunal what happened if the company is shut down, but he just *shrug*...

Hello friendz....

Thanks again for your moral support. Today I already managed to get my money back. They have prepared the cheque, am just collect and signed received. But the workshop owner said "DUIT INI AKU TIDAK HALALKAN DUNIA AKHIRAT" and siap tulis kat belakang cek "PENIPUAN INI SAYA TIDAK HALALKAN DI DUNIA AKHIRAT".

I malas nak gaduh2, penat dah bercakap sebelum nie. I cakap ngan dia u jangan cakap pasal halal tak halal n dunia akhirat.... i cuma nak hak i balik itu saja....

Kalau dia nak tegakkan kebenaran dia,... kenapa x datang ke mahkamah. I tanya dia kenapa x datang mahkamah.... Dia siap tunjuk kaki dia bengkak, than i tanya dia kenapa, dia boleh cakap tak tahu mungkin ader orang buat ...( sound like nak tuduh cakap i bomohkan dia ). I malas nak panjangkan cerita karut tu.... i buat bodoh ajer. Memang workshop tu n their owner HATI BUSUK.

btw can ask for a favour.. could you post some detail on how to make or submit a small claim to the tribunal court as a future reference to other who might faced the same predictiment.

eg.
1. where to get the form
2. how to submit the form (cost involve)
3. time frame or expectation for a hearing

Sharing information to others...

Actuall i know about this tribunal from my friend, he got a problem during sent his Alfa to the workshop for overheating problem.

The procedure are :

1. Advice from the judge,... firstly discuss with the third party and try settle softly, if cannot u can bring up to tribunal.

2. U can take the form from tribunal office according to the case location. - My case in selangor area, the form can get at PKNS Shah Alam.

3. Launch a report in 3 copy, 1 for third party, 1 for tribunal and 1 for u.

4. The original copy send to the third party by POS BERDAFTAR and pay extra for the receipt card, that the avidance for the third party received your document. That card also need to bring during the judgment day.

5. Within 14days the third party need to reply your report.

6. After 14 days, the tribunal will set the time for judgment day.

7. After judge comeout with the award, the third party need to be settled within 14 days.

Everything the tribunal will advice you how the procedure... anyway, firstly get the form from the nearest Tribunal Pengguna Office... biasanya dekat dengan Kementrian Perdagangan Dalam Negeri dan Hal Ehwal Pengguna.

btw, based on your experience, can you also claimed for your expenses incuured or interest?

I think you mentioned the maximum amount is RM2k. Any thing more have to be dealt as civil case???

ok... one more thing, we can claim additional cost cause of susah payah up to RM200 not RM2k. and the judge will decide the amount base on the report and problem occurs.

once we launch a report regarding consumer matter,its under tribunal and it will not bring up to civil court., any civil case handled by civil court. if it become worst, the next procedure, we need launch a report up to Pengarah Kem. Perdagangan Dalam Negeri dan Hal Ehwal Pengguna.... at that time maybe lesen kena tarik kot.

Sbb kalau dia berkeras tak nak bayar contohnya, dia akan dikenakan denda RM5000 atau penjara 2 tahun atau Denda RM 1000 setiap aduan kita sekiranya berkeras tak mahu bayar.

Just to add on...
1. Tribunals will do all consumer/sales transaction up to a maximum of RM25000.

2. The company/establishment must HAVE a valid business address.

3. You will need to pay a one time RM5 administration fee. You got it, ONLY RM5.

4. Bear in mind, the company you are suing do have chargeback rights too. If this happens, you will need to fill up another form.
