anyway, on the matter of releasing the name of the workshop publicly, i don't really see what is the big issue. This is a forum, and whoever take advice here by other bros. must take it with a pinch of salt. So what is the harm in letting the name known?

The issue about releasing the name is quite simple. Say, I own a workshop in Timbuktu serving BMW. There is another workshop also servicing BMW 100m away from my shop and doing very good business. Being jealous of his business, I come to this site and say that I sueing the shop because of bad service. Guess what will happened.. The shop with a good reputation should be able to withstand all the accusation or its reputation might be tarnished. Either way, some harm have been done.

BTW, ferry, congrat in winning the claim.. Sometime we have to stand up for our right which many of us would take for granted or couldn't be bothered becoz it too troublesome.

Hello friends...

That workshop doesn't reply my report to defend them and they doesn't come to the court also. Now court already cameout with the instruction (perintah mahkamah) , the workshop must pay full to me what ever i claimed within 14 days. Tak banyak pun RM1061 ajer.

ferry, I am yet to congratulate you because you haven't got back your RM 1,061. First of all, what judgment do you got. ? is it just 'Perintah Ingkar'.
2ndly, If the w/shop still don't pay you, how ? Who is going to do the enforcement here and when ?

Maka, till you got back your money, kes belum selesai.

My advise is find a police officer friend and friend in the court. They are the one doing the enforcement. another advise is ask help from 3 line to bvkdr kedai tu ... habis cerita.

I have told the hakim, this workshop very very belagak.... hakim said, "kita tengok sejauh mana dia nak belagak, saya keluarkan perintah, jika dia tetap engkar, kita akan ambil tindakan selanjutnya".... but he didnt say what is another action. We look and see.

The Order given is an Order in Default... personally I've not seen one from such a court. However, if the said Order has the same effect of orders or Judgments of the Judicial Courts then you may proceed with the enforcement thereafter. I believe the current actionable minimum amount debt due from a Judgment debtor (Company) is RM500.00. So following that, with the amount of your order, you may pursue to wind up the Company and then collect, since the company will obviously settle and not allow itself to be wound up for such a sum.... possible avenue for you to think about Ferry...congrats

Maybe but am not sure. What i know, the tribunal courts will not involve with any judgment debtor company even though not required any lawyer for attend any case. if they dont pay to me whithin 14days,.. that i say, the judge didnt tell me what is the further action. at the same time i will see workshop to collet my money.... if they fail to do, lets judgment to decide for further action....

thats right, mmg betul. he can argue with the judgement awarded becoz he didnt come. but what do u think, time given to them to reply and protect against my report but they dont do that and also not come to the court,... DIA NAK TUNJUK TERROR. . if they bring up again to the court, i will launch another report to claim my difficulties....claim max up to RM200.00 . Automatically judge can instruct them to pay me. Clause stated max claim for difficulties, do and there - RM200.00

for me the case is settle, am wait for my money..... if they dont want to pay....SIAPPP

A suggestion.. why dont you just go to the shop, and show to the boss abt the judgement and ask him to pay u the RM1061, and case close.. Otherwise, u can proceed further like threathen to seal his shop ka (but i doubt the owner is concerned at all, maybe got used to it oredi..) if it is allowed.

Anyway, dont worry, am sure the shop will know who is the boss finally, Yes, its the Mr presiden, Mr Rungit.. and of course we all lah, as the customer !

FYI, the court will send officially the judgement instruction " Perintah Mahkamah " to the workshop using sampul surat rasmi. One copy for me to keep as reference to chase my money. Within 14 days they must pay to me the amount. After 10days i will see the workshop and collect my money. Just look and see..... i will inform my brother in-law DSP... get his help

My judgement very very bad, interm of entertain customer, belagak banyak. about performance, still learning, try and error, suka nak bodohkan orang. HAMPEHH.
