  • Questions on AP cars

    Thanks guys for the welcome at the newbies section!

    I am a bit concerned on friends teling me that Customs taking away cars with AP for inspection. If I were to buy cars from these AP people in town :

    1) assume i had bought : if Customs one day come at my house and say that there is AP problem or something does it mean they can take my car away ? If yes, like that very susah-lah , monthly installment i have to still pay but the car is not with me anymore probably rotting away in a yard under the hot sun !

    2) assume i have not bought but just paid my 10% booking : the customs went to the dealer and hauled up their cars, and the dealer tell me "sorry u can't get your car until it is released" which could be 2-3 months time, will they return my 10% ?

    However, i do have several friends who had bought AP cars before and had no problem. But they have since sold of the cars and changed to other cars. But what do i need to do first ? Can i ask for the documents of the AP ? How do I check with Customs to make sure that this car is "clean" so that i won't get "raided" ?

    is there any recommendations on a legitimate AP car dealer ?
    please advise

    get the dealer to refund ur deposit if they cant give u the car as promised put in writing on the receipt. AP car upon registered the custom will not chk and take the car from the owner un less the car are stolen car which u can sue the dealer if they sell u a stolen car. it will become legal case....
    u cant chk so details unless u have contact in MITI to verify the AP , MITI isseu thousand of AP every year so how to chk ??
    Anything happen u sue the dealer or get then to write u a commitment letter that they will refund if the car is stolen or....????
    or call up pekema they might be able to help u.

      Thanks tkew ! I am so glad someone answered !
      I am looking both sides now : recon new registration and 2nd hand (local)

      finance-wise i found that the finance company offer lower rate for the unreg recon cars caused it is deemed "new" and a higher rate for the 2nd hand bmws (local and recon). I wanted to buy from my friend, he is selling his 2000 318i recon for 117k but becoz it is considered 2nd hand the best financing i can get is 90k. I have to fork out around 30k !!! it is like a down payment for a house. ....

      then the same finance guy told me if i don't want to put up a lot, take a recon car unreg, he can give me cheaper rate, coz deemed "new" and for out around 12k. at first i tot he was trying to con me or something, then i asked the other companies apparently it is the same. they have 2-tier rates - new & used

      Sorry, I am new, so please excuse my "blurness" :
      what does pekema stands for ? Persatuan something ...... ???

        Hi guys,

        1 of my friend need some input on this issue. Hope some of you can shed some opinion/s on this matter.
        He wanted to buy a registered car which was brought in year 2003 and car manufactured year also 2003. However the first attempt for loan, direct deal with owners has been rejected by finance com, due to some unexplained AP issue.
        Now the car is being handled by a dealer and claim there will be no issue for loan arrangement.

        Question:
        1. Can he really buy the car and drive it with peace of mind?
        2. Any other issue on AP which was used by the car (new) but uses a "import terpakai" AP?
        3. Will the car be compounded by custom if they managed to find it?
        4. Will he face any probrem disposing the car after few years?
        Hope someone could help and thanks in advance.

            Banks today do very thorough checks on imported cars(AP cars). I used to own a CBU car as well.

            If there is a problem with the loan, and the reason being AP issues in the first place.. i would stay away from the car.. Even more so, now that a dealer has it, and claims he can settle everything. There must be a reason why the bank rejected it in the first place.

            safe thing to do, just walk away, i'm sure there are other cars for sale out there right?

                Golden rules:
                1. If buying an AP car, ensure the dealer is a big reputable one and not a small outfit that cuts corners and can close shop literally overnight. There are those only out to make a quick buck.
                2. If a finance co rejected the deal already, as 1+2=3 said, walk away. Unless you like to flirt with danger.

                  If you do buy a car brought in with an AP... the AP will be given to you for registration purposes... keep a copy of it... when u register your car the AP will have to be given to JPJ...

                  most dealers even franchise holders like AB bring in AP cars... but becos they are franchise holders it will be easier to get a loan for it... problems with AP means big trouble... so don't go back to the shop...

                  reputable AP holder???... who else... Tan Sri Nasimuddin's Company... NAZA Motors... and they also hold the franchise for many makes nowadaysss...

                  my two cents.

                    Abatman, Pekema is the bumiputra car importers and dealers association based in Ampang. Their members only import Toyotas and Mercs, so they don't do BMW.

                    If it is a case of forged or cloned AP like in the news recently, the car will be confiscated by Customs and your only recourse will be to sue the dealer for refund and damages.

                    But with civil cases backlog stretching 3 to 4 years in the courts, by the time your case come up, the company may have wound up and the Directors are untraceable. The Directors are often only proxies anyway, lending their names. Meantime you have no car, and you STILL have to settle the HP loan!! Is it worth the risk to buy a car with doubtful AP status?

                      AP

                      ok..since i happens to know the work flow of AP, tentatively, if my memory allows:

                      1) get copies of the Export Cert (which would indicates the car's details back in uk/japan/etc.), this ensure car is properly bought and specs are accurate);
                      2) get copy of bill of lading (i.e. to make sure your imported have fully paid the exporter, otherwise might have problem later too);
                      3) get copy of Custom K8 Form (for partly paid tax). for more comfort, u can verify the details, i.e. AP holder/applicant name, registration no., etc with MITI and/or Pekema;
                      4) before registration with JPJ u shld get copy of the Custom K1 Form (full tax paid). again if u r kiasu, verify with MITI/Pekema.
                      5) good practise to also get the Puspakom certification letter too (a must process for all AP car before it can be registered with JPJ). and i believe there's another vehicle check recently imposed by Custom side before registration too (cant recalled the name);
                      6) lastly, get copy of the Car Registration Card from JPJ.

                      note: for naza/mofaz imported cars, u may not get the K8 Form as they would have the balance sheet strength to pay full tax upfront before even closing a sale.

                              u will be surprise to know, that most APs are EAST Malaysia APs. here things get done "easily".

                              anyhow, ur price wont get tekan for the AP, u might get it knocked down cos of the sabah/sarawak number plate.

                              but by saying that, it doesnt mean that with east malaysian AP u cant find the cars in west malaysia ready for it to be registered in these parts. East Malaysia companies have become wiser as certain models tend to be sold here cos there is a higher demand, therefore it goes through their subsidiary companies based here.
